Sources have stated that the Madras High Court on Tuesday has set aside the order of the Union government denying security clearance to Sun Network that had made it ineligible to participate in the phase-III auctions for FM radio broadcasting.


It is said that Justice M. Duraiswamy has passed the order on the writ pleas moved by Sun Network Limited, Kal Radio Limited and others seeking the court to quash the order of the Union Ministry of Information and Broadcasting dated July 15, 2015 and allow them to migrate to FM Phase-III regime.


The Sun Group which operates about 45 FM stations across the country, found itself out of the list of applicants eligible to participate in the phase-III auctions triggering a major controversy and later, the Sun group was served with a communication stating that the applications of the company was rejected.


Previously  the high court through an interim order permitted the media group to participate in the auction with a rider that it would be subject to final outcome of the case, following the order the bid which was made by the petitioner were submitted to the court in a sealed cover.
