Uttar Pradesh CM Akhilesh Yadav got huge shock from High Court ahead of the upcoming assembly elections. It is known that Akhilesh Yadav's government passed a GO including 17 sub-castes in the Scheduled Castes list on Dec 22nd last year.
The 17 sub castes were earlier classified in the Other Backward Classes category. Allahabad High Court on Jan 12, directed the Uttar Pradesh Government to file its reply following a petition challenging the decision.
Petitioner alleged that the decision was in violation of Article 341 of the Constitution which empowers only the Centre, and not the states, to decide the inclusion or exclusion of any caste group in the list of the Scheduled Castes.
Now Allahabad High Court passing its order stayed the Uttar Pradesh government's order to include 17 sub-castes in the Scheduled Castes (SC) category.Even earlier opposition parties cried foul saying that the decision was politicaclly motivated.
