Can the CM Kiran Kumar Reddy file a petition in supreme court opposing the Telangana Bill? A serious debate is raging in party and legal circles on what capacity can the Kiran Kumar Reddy file a petition in Supreme Court against unjust bifurcation. Legal experts say that Kiran file petition on his personal capacity and not as CM of the state as it was his party government at centre that had moved the BIll to President. If the CM chooses to approach the Supreme Court, he will have to get the state Cabinet’s approval. He is already attacked for his resolution which has not been endorsed by the cabinet ? The T Bill has been rejected by a symbolic voice vote in the state Assembly and this has left many Telangana lobbyists including the Deputy CM and the Congress hig shots at Delhi fuming .Congrerss secretary Digvijay Singh has also told CM Kiran that whatever he did Telangana will be reality soon.During the assembly session some members from the Congress party had given notices to the Speaker protesting against the resolution moved by the CM. In case he chooses to go to Court directly through the Chief Secretary, then the Telangana ministers are bound to file counter petitions. This will make a huge dent to the Party’s image all across the country. Also, it is not clear as to what extent the Supreme Court can intervene without Cabinet’s approval. However, if Kiran Kumar Reddy manages to get individuals to file a petition in Supreme Court, then the situation will be totally different. All that means that Ki8ran can not file petition as CM or individually and have to resign if he wanted to personally get involved . So, it is highly unlikely that the CM can file a petition against bifurcation in his official capacity.However there were seven petitions before the Supreme court pending admission including the one by AP NGOs and the former YSRC but now in BJP Raghuramakrishna Raju.
