As per the latest news the Supreme Court has appointed special investigation team (SIT), which is the prosecuting agency in the 2002 Gulbarg Society massacre case, has sought death penalty for all 24 convicted in the case including 11 held guilty for murder and 13 for lesser offences. 


The special prosecutor R C Kodekar on Monday has termed Gulbarg massacre as the rarest of the rare case and has demanded that convicts should be sentenced to life imprisonment till their death if they are not awarded capital punishment.


The Special prosecutor told court that Gulbarg crime was cruel, barbaric and inhuman because innocent women and children were killed without any provocation simply because they belonged to a minority community.


The Defense advocate Abhay Bhardwaj has submitted that since the court has exonerated convicts of charges like common intention, criminal conspiracy and gang rape, death penalty cannot be awarded without total certainty and on basis of evidence partially relied upon. The convicts can also not be held accountable for 30 missing persons.
