As per report from sources it was stated that the Supreme Court Bench of Justices P.C. Ghose and Amitava Roy will, on Wednesday, consider a review petition filed by the Karnataka government, challenging the abatement of its appeal against former Tamil Nadu Chief Minister Jayalalitha in the disproportionate assets case.



Meanwhile it was stated that the Bench will decide the petition by circulation and also consider an application for “personal hearing” before the court.

The State contended that the Supreme Court's finding in its February 14, 2017 judgment that the corruption case against Ms. Jayalalitha stood abated with her demise on December 5, 2016, was an “error on the face of the record.”



“If a party dies after the conclusion of the arguments and the judgment is reserved, there is no question of abatement of appeal,” Karnataka had submitted. The State said though a plea for a jail sentence had become “infructuous”, the court should have ordered the recovery of the 100 crore fine imposed on Ms. Jayalalitha by the trial court from her estate.
