The Chennai high court suggested government to modify Pocso Act and exclude teenage and consensual sex involving people from 16 years of age and differentiate them from sexual assault cases.
Justice V Parthiban, who released a youngster who was sentenced to 5 years imprisonment under Pocso Act for kidnapping a minor girl after investigation revealed the girl had eloped with him and it wasn't a kidnap.
The 17 year old married him and they lived for six months. The judge added that the relationships with people less than 18 years of age are due to attraction which is not unnatural and as girl can provide consent even before 18 years, the Pocso act must not treat it as sexual assault case and requested TN government to amend Pocso act.
