Accordingly the Supreme Court on Thursday asked the Kerala government to confirm if the memory card in the 2017 actor assault case is being treated as a document or a material object. Meanwhile depending on the answer that the Kerala government is expected to give by Friday, the court will decide whether Dileep can access the visuals.

Furthermore the top court posed the question in connection with accused actor Dileep’s plea to access all documents related to the case, including the video recording of the attack stored in the memory card. Apparently the card has visuals of the attack which was transferred from main accused Pulsar Suni’s phone and hence Dileep had moved the Supreme Court stating that accessing a copy of the visuals will help prove his innocence.



Under Section 207 of the CrPC states that a magistrate is supposed to furnish to the accused, free of cost and without delay, copies of police report, FIR and any other document or relevant extract forwarded to the magistrate along with the police report. Moreover if the memory card is treated as a document, then the trial court can decide if a copy of its contents can be supplied to Dileep and if so, how much of this document whether partial or the entire recording can be furnished to the accused, the Supreme Court observed.
