After the deadline ended for withdrawal of nomination papers by 3 pm, Dubey won the seat unopposed. He was later handed over the certificate. Late Mr. Jethmalani won the seat from quota of Nitish Kumar’s party, RJD supremo prasad YADAV' target='_blank' title='lalu prasad yadav-Latest Updates, Photos, Videos are a click away, CLICK NOW'>lalu prasad yadav had an alliance with former party then, he was offered the seat because he represented Yadav in fodder scam case.

Initially it was expected that JDU might contest the by-elections. Perhaps this decision could well be a good move by Nitish, since he can bargain with BJP in state assembly elections. Meanwhile, BJP tried to soothe the sulking Dubey by offering him the Rajya Sabha seat. He along with few other leaders were disappointed after the party’s ignorable attitude  towards traditional voters of Brahmins and Bhumihars.
