Reportedly in a fresh move, the US Embassy has asked work visa applicants to apply 90 days prior to their employment date. Meanwhile it informed the work US visa applicants to apply before the employment start date mentioned on their I-797 form. The USCIS website states "Applying for your work #USvisa? You can apply up to 90 days before the employment start date noted on your I-797 form”.

The US Embassy wrote in a tweet “The I-797 form is a document the united states Citizenship and Immigration Services (USCIS) uses "to communicate with applicants/petitioners or convey an immigration benefit”. Moreover the US work visa for Indian nationals is one of the most crucial issues between US and india bilateral ties and it is one of the highly demanded work visas among highly skilled Indian professionals. It is a non-immigrant visa that allows US companies to employ foreign workers in specialty occupations which require theoretical or technical expertise.



Apparently the US companies should show strong reason before hiring skilled professionals from other countries. Meanwhile, there is a proposed ban on the H4 employment authorization document. The proposed rule bans the work permits to the spouses of the H-1B workers and this may not materialize before 2020.
