Presently a batch of private has teamed up with Tamilnadu Nursery, Primary, Matriculations and Higher Secondary schools Association has moved the Madras High Court assailing certain rules of the Tamilnadu Motor Vehicles Special rules 2012 as unconstitutional and discriminatory.


The issue was made after the death of seven year old girl named Shruthi, a class 2 student of a private matriculation school in Selaiyur, Chennai who has fallen through a hole in the floor of her school bus and the vehicle has run over her during July 26th 2012.


The court has directed the state government to frame rules by governing the operation of the school buses and other vehicles that transport the students and so the government has introduced the special rules in 2012. The petitioners have challenged the rules and have told that various provisions were inconsistent with and contrary to the provisions of Motor Vehicles Act and Central Motor Vehicles Rules.


The petitioners have told that certain provisions were incapable of compliance as they are contrary to other provisions of the Act and rules certain provisions are without any rationale. The Bench has directed the petitioners to list the major problems they perceive the implementation of the rules.
